Terms of Sale

1. Order & Acceptance

By placing an order on sierachart.com, you agree to purchase digital products (templates, indicators, or related services) from PFORTRESS LIMITED, a company incorporated in Hong Kong. Your order becomes a binding contract only when we send you a confirmation email accepting your payment.

2. Price, Payment & Taxes

Prices are displayed in the currency specified on the checkout page (typically USD or EUR). As PFORTRESS LIMITED is based in Hong Kong, we do not charge local Value Added Tax (VAT) or Sales Tax on our side.

For international customers: You are the importer of record. Depending on your local laws, you may be responsible for declaring or paying specific local taxes (such as VAT, GST, or Consumption Tax) in your country of residence. Payment must be made in full at the time of order via the secure payment methods offered.

3. Delivery of Digital Products

Once your payment is accepted, you will receive a download link or access instructions via email. The product is considered delivered and "consumed" as soon as the download link is sent to you or accessed.

4. Intellectual Property & License

All intellectual property rights (copyrights, designs, code) remain the exclusive property of PFORTRESS LIMITED. Purchasing a product grants you a limited, non-exclusive, non-transferable license to use it for your own personal or business trading analysis. You may not resell, redistribute, sublicense, or share the product or its source code with third parties without our explicit written permission.

5. Refund Policy (No Right of Withdrawal)

Unlike physical goods, digital content is exempt from standard withdrawal periods once accessed. As a Hong Kong-based entity, we do not offer a mandatory "cooling-off" period for digital downloads.

All sales are final. However, we stand behind the quality of our tools. We offer refunds only in the event of a verifiable technical issue that prevents the product from functioning as described, provided you have contacted our support team and allowed us to attempt a fix. To request a technical refund, contact us within 14 days of purchase.

6. Limitation of Liability & Warranty

We make reasonable efforts to ensure our products function correctly on standard Sierra Chart installations. However, trading software environments vary. To the fullest extent permitted by Hong Kong law, PFORTRESS LIMITED disclaims liability for any direct, indirect, incidental, special, or consequential damages (including trading losses) arising from the use of our products. Our products are analytical tools, not financial advice.

7. Changes to Terms

We reserve the right to update these Terms of Sale at any time. Changes will apply to orders placed after the new version is published.

8. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Hong Kong Special Administrative Region. In case of dispute, after an attempt at amicable resolution, the competent courts of Hong Kong shall have exclusive jurisdiction.
